These Terms & Conditions ("Agreement") govern your use of the prescription refill request system and related services provided by Compound Central Pharmacy ("we," "us," "Company," or "Service"). By submitting a refill request or using our online services, you agree to be bound by these terms.

1. Service Description

Compound Central Pharmacy provides an online prescription refill request system that allows patients to request prescription refills and receive status notifications via text message, phone call, or email. This service is intended to facilitate communication between you and our pharmacy regarding prescription refills only.

What This Service Is Not

This service is not a substitute for speaking directly with a pharmacist. It is not an emergency service and should not be used for urgent medical matters. If you have a medical emergency, please call 911.

2. Eligibility

By using this service, you confirm that:

You are at least 18 years old or have parental/guardian consent
You are a patient of Compound Central Pharmacy or authorized to request refills on behalf of a patient
The information you provide is accurate and truthful
You have the right to receive communications to the phone number and email address you provide

3. Acceptable Use

You agree to use this service only for legitimate prescription refill requests. You agree not to:

Submit false or misleading information
Request refills for prescriptions that do not belong to you without proper authorization
Use the service for harassment, threats, or abusive communication
Attempt to access unauthorized portions of the system
Use the service in violation of any applicable laws or regulations

Violations of these terms may result in suspension or termination of your access to the service without notice.

4. SMS Text Message Terms

Enrollment

By checking the "Text" notification option and submitting your refill request, you are providing your express written consent to receive SMS text messages from Compound Central Pharmacy at the phone number you provide. You understand and agree that:

You will receive two text messages per refill request: one confirming receipt of your request, and one notifying you when your prescription is ready for pickup
Messages will be sent from +1-833-913-0611
Standard message and data rates from your mobile carrier may apply
Message delivery depends on your mobile carrier and network availability; we are not responsible for delays or failures caused by your carrier

Opting Out

You may opt out of SMS notifications at any time by:

Replying "STOP" to any text message
Contacting us at info@compoundcentralpharmacy.com or (562) 555-PHARM

Once you opt out, you will no longer receive SMS notifications, but your refill request will still be processed through other available channels (email or phone call, if selected).

Message Timing

Confirmation messages are typically sent within 1 hour of request submission. Ready-for-pickup notifications are sent when the prescription is filled and available. Message delivery may be delayed due to network congestion or carrier issues, which are beyond our control.

5. Limitations of Service

We make reasonable efforts to ensure accurate and timely communication, but we do not guarantee:

Immediate Processing: Refill requests are processed during regular pharmacy hours. Requests submitted outside these hours may be delayed
Message Delivery: SMS delivery depends on your mobile carrier. We are not responsible for messages that are delayed, blocked, or not delivered due to carrier issues, network congestion, or device problems
Service Availability: While we strive for continuous availability, we do not guarantee uninterrupted access to the service
Accuracy: We do not guarantee that refill eligibility or prescription details are accurate in real-time

Do Not Use for Emergencies

If you have a medical emergency or urgent medication need, call the pharmacy directly at (562) 555-PHARM or call 911. Do not rely solely on this online system for urgent requests.

6. Limitation of Liability

IMPORTANT: TO THE FULLEST EXTENT PERMITTED BY LAW, COMPOUND CENTRAL PHARMACY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

Our liability for any claim arising from this service shall not exceed the value of the prescription refill(s) in question.

What This Means

If a message is delayed or missed due to carrier issues, system failure, or other reasons, and you experience harm (missed doses, etc.), we are not responsible for damages beyond the direct cost of the prescription. This is a condition of using this free or low-cost service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING:

The accuracy, completeness, or reliability of the service
Uninterrupted or error-free operation
Fitness for a particular purpose
Non-infringement of third-party rights

Your use of this service is at your own risk.

8. Your Responsibilities

You are responsible for:

Providing accurate information in refill requests
Maintaining the confidentiality of any account information
Notifying us immediately if you experience a breach or unauthorized access
Verifying refill eligibility with the pharmacy before requesting a refill
Contacting the pharmacy directly for any urgent medication needs

9. Privacy and Data Protection

Your use of this service is subject to our Privacy Policy. By using this service, you consent to the collection and use of your information as described in the Privacy Policy, including SMS transmission through Twilio.

10. HIPAA Compliance

Compound Central Pharmacy is a HIPAA-covered entity and handles your Protected Health Information (PHI) in compliance with HIPAA regulations. We maintain administrative, physical, and technical safeguards to protect your health information. However, email and text message are not completely secure methods of communication. If you prefer a more secure method to discuss your prescription, please contact the pharmacy directly by phone.

11. Modification of Terms

We may modify these Terms & Conditions at any time. Modifications become effective upon posting to our website. Your continued use of the service following modifications constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

12. Termination

We reserve the right to terminate or suspend your access to this service at any time, with or without cause, and without notice. Reasons for termination may include:

Violation of these Terms & Conditions
Abuse or misuse of the service
Failure to provide accurate information
System maintenance or discontinuation

13. Governing Law

These Terms & Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising from this service shall be exclusively brought in the state or federal courts located in Los Angeles County, California.

14. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Compound Central Pharmacy regarding the use of this service and supersede all prior agreements or understandings.
